SENATE BILL 408
AN ACT relative to a school district’s policy informing parents of bullying incidents.

This bill repeals the provision requiring a school’s policy on bullying and cyberbullying to contain a waiver from parental notification and makes the waiver from notification procedure discretionary.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twelve
AN ACT relative to a school district’s policy informing parents of bullying incidents.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Pupil Safety and Violence Prevention. Amend RSA 193-F:4 by inserting after paragraph II the following new paragraph:
II-a. In addition to the requirements set forth in paragraph II, a school board’s policy may include a procedure authorizing the superintendent or designee, to grant the school principal or designee a waiver from the notification requirement specified in subparagraph II(h) if the superintendent or designee deems such waiver to be in the best interest of the victim or perpetrator. Any waiver granted shall be in writing. Granting a waiver shall not negate the school's responsibility to adhere to the remainder of its approved written policy.
2 Repeal. RSA 193-F:4, II(i), relative to the superintendent’s authority to grant the school principal a waiver from the requirement to notify a parent or guardian of a school bullying or cyberbullying incident, is repealed.
3 Effective Date. This act shall take effect 60 days after its passage.
