STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to increasing the membership of the board of marital mediator certification and renaming marital mediators as family mediators.

Be it Enacted by the Senate and House of Representatives in General Court convened:

21:1 Board of Marital Mediator Certification; Membership Increased. Amend RSA 328-C:4, I to read as follows:

I. There shall be a board of marital mediator certification consisting of the following [9] 11 members:

(a) One judge who regularly sits in the judicial branch family division, appointed by the chief justice of the supreme court.

(b) One full-time marital master, appointed by the administrative judge of the judicial branch family division.

(c) One attorney licensed to practice law in this state, appointed by the governor with the consent of the council.

(d) Two members of the public, appointed by the governor with the consent of the council.

(e) One mental health professional, appointed by the governor with the consent of the council.

(f) [Three] Five certified marital mediators, nominated by the New Hampshire Conflict Resolution Association and appointed by the governor with the consent of the council.

21:2 Application; Increase of Board Membership. The 2 members of the board of marital mediator certification added pursuant to section 1 of this act shall be nominated and appointed under RSA 328-C:4, I(f) for 3-year terms to begin in 2009.

21:3 Chapter Heading; Change to Family Mediators. Amend the chapter heading of RSA 328-C to read as follows:

[MARITAL] FAMILY MEDIATORS

21:4 Name Change; Family Mediator. Amend the following RSA provisions, as appropriate, by replacing “marital mediator” or “marital mediators” with “family mediator” or “family mediators,” respectively: 328-C:1; 328-C:2; 328-C:3; 328-C:4, I; 328-C:4-a; 328-C:5, I and II; 328-C:5-a; 328-C:6; 328-C:7; 328-C:8; 328-C:9, III; 328-C:10; 328-C:13; 458:15-c, I(b); 461-A:1, III.

21:5 Name Change; Family Mediation. Amend the following RSA provisions, as appropriate, by replacing “marital mediation” with “family mediation”: 328-C:1; 328-C:2, IV; 328-C:5, II(b) and II(d); 328-C:9; 328-C:10.

21:6 Effect of Name Change from Marital Mediator to Family Mediator. Nothing in this act shall affect a marital mediator or marital mediator training program validly certified as such on the effective date of this section, except that such person or program shall be known as a certified family mediator or certified family mediator training program on or after the effective date of this section.

21:7 Effective Date.

I. Sections 3-6 of this act shall take effect January 1, 2010.

II. The remainder of this act shall take effect upon its passage.
