This bill requires the department of health and human services to expand Medicaid eligibility under the healthy kids program to eliminate the potential for a gap in insurance coverage as children transfer from “healthy kids gold” to “healthy kids silver.”

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to the healthy kids program.

Be it Enacted by the Senate and House of Representatives in General Court convened:

317:1 New Section; Transitional Healthy Kids Silver Program Waiver. Amend RSA 126-A by inserting after section 4-d the following new section:

126-A:4-e Transitional Healthy Kids Silver Program Waiver.

I. The department shall develop and submit to the federal Centers for Medicare and Medicaid Services for approval a limited Medicaid expansion to provide for transitional Medicaid eligibility for children whose eligibility for Healthy Kids Gold terminates mid-month and who are eligible for Healthy Kids Silver but will not receive Healthy Kids Silver coverage until the first of the month following Healthy Kids Gold ineligibility. Coverage of Medicaid services during the transition period shall be funded using State Children’s Health Insurance Program (SCHIP) funds. The commissioner shall adopt rules pursuant to RSA 541-A to implement the provisions of this section.

II. On or before January 10, 2010, the department of health and human services shall submit a report to the speaker of the house of representatives, the president of the senate, and the governor verifying the steps the department has taken to implement the transitional program and ensure that there is no gap in coverage for children transferring from healthy kids gold to silver.

317:2 Contingency. If SB 42 of the 2009 legislative session becomes law, RSA 126-A:4-e as inserted by section 1 of this act shall be renumbered as RSA 126-A:4-f.

317:3 Effective Date. This act shall take effect 60 days after its passage.
