SENATE BILL 26-FN
AN ACT prohibiting the fish and game department from stocking fish in certain water bodies without public access and requiring public access for Big Island Pond.

This bill prohibits the fish and game department from stocking fish in any stream, pond, or lake that does not have acceptable public water access as determined by the public water access advisory board. The bill also requires the acquisition of suitable public access for Big Island Pond.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Seven
AN ACT prohibiting the fish and game department from stocking fish in certain water bodies without public access and requiring public access for Big Island Pond.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Propagation of Fish; Public Water Access. Amend RSA 212 by inserting after section 21 the following new section:
212:21-a Fish Stocking; Public Water Access. The executive director shall not include in a fish stocking program administered by the department any stream, pond, or lake that does not have suitable public water access as determined by the public water access advisory board established in RSA 233-A.
2 Public Access Required; Big Island Pond. The fish and game department, in consultation with the public water access advisory board under RSA 233-A, shall acquire, establish, and maintain a suitable public access for Big Island Pond located in the towns of Atkinson, Hampstead, and Derry by December 31, 2008.
3 Effective Date. This act shall take effect 60 days after its passage.

SB 26-FN - FISCAL NOTE
AN ACT prohibiting the fish and game department from stocking fish in certain water bodies without public access and requiring public access for Big Island Pond.
FISCAL IMPACT:
The Fish and Game Department states this bill will increase state fish and game fund expenditures by an indeterminable amount in FY 2008 and each year thereafter. There is no fiscal impact on state, county, and local revenue or county and local expenditures.
METHODOLOGY:
The Fish and Game Department states that this bill prohibits stocking fish in any body of water that does not have acceptable public water access and requires the acquisition of suitable public access for Big Island Pond.
Section 1 of this bill will add responsibilities to the Public Water Access Advisory Board (PWAAB). The Department is responsible for the administrative support of the PWAAB. Any additional PWAAB costs will be paid by the Department. These costs are indeterminable. Section 1 also defines the phrase “public water access” to match the definition in RSA 233-A:1, which is restricted to state owned and controlled property. The Department states that if this definition is applied to the fish stocking program, it would have an indeterminable fiscal impact on expenditures since each stream, lake or pond would have to have a state owned property to provide public access.
To comply with the provisions in section 2 of the bill for public access to Big Island Pond, the Department would be required to obtain property, design and build access facilities. The Department states these costs are indeterminable, but if the land could not be obtained through donation, costs would range from $300,000 to $400,000 as estimated below:
Acquisition of property $200,000 to $300,000
Design $14,000
Permitting $10,000
Construction $76,000
The Department states that project expenditures will begin in FY 2008 and maintenance costs will continue thereafter.
